Expert Witness:

Slip Accident Specialist

Slip Guru Director Ben Powers brings together the court-focused experience of a forensic engineering consultancy, with the benefit of "muddy boots" daily involvement in the assessment of slip risk.  Producing site-based or desktop reports on a monthly basis, he provides a simple yet powerful expert witness solution in the narrow specialist field of pedestrian slipping accidents.
Ben Powers

Expert Profile

An approximate split of 60/30/10 for Claimant/Defendant/Joint instructions respectively.
Able to speak with authority on the subject of pedestrian slip accidents and slip resistance with experience spanning over 18 years and 10,000 tests, in wide range of environments and scenarios.
Regular involvement in civil slip injury cases in English and Scots Law, experience in conducting site visits producing expert reports, joint statements and attending court.  Positive feedback from lawyers and judge preferred evidence.
Whilst involved in and keeping abreast of high-level academic development of the science of slip resistance, Ben's experience is drawn from thousands of hours of 'muddy boots' practical on-site assessment.  He is equally at home addressing a conference of his peers or conducting tests of a surface in the field.

Case Synopsis

2025

Severe injury following a slip in the street

The case was complicated as testing of the material surface was impossible and slip resistance had to be estimated from available alternative surfaces and measurements.  Despite a very well regarded opposing expert the case was settled in the favour of Ben's instructing solicitors.

2023

Head injury after a slip in a department store

Ben was asked to provide a desktop report considering CCTV, witness statements, accident reports, cleaning regimes, singage, test data, anti-slip treatments and weather reports.  The matter was settled before reaching court, in favour of Ben's instructing solicitors.

2022

A slip on composite decking in a holiday park

In this case the slip accident was not disputed, but there were arguments around application of testing and effects of cleaning and wear.  The Judge preferred Ben's testing evidence, which was shown to closely follow best practice, over that of an experienced but less specialised career expert witness.

A Good Fit For Your Case?

>18yrs Specialised Industry Experience

Ben's career has focussed on conducting industry best-practice slip testing and risk assessment, on a daily basis, since 2007.  Few in the industry, even those with longer tenure, will have conducted as many slip risk assessments, or be experienced in such a wide range of environments, surfaces and scenarios.

Active UKSRG and BSI Member

Ben contributes to the standards that lead the industry; a named contributor to the latest UK Slip Resistance Group Guidelines and an active member of the British Standards B/507/7 comittee responsible for BS EN 16165:2021 (Pedestrian Slip Resistance).

A Decade of Expert Witness Experience

Ben spends most of his time helping clients understand the slip risk in their premises, as opposed to a career expert witness focussed solely on court cases.  Nonetheless, he has contributed to numerous cases, had the judge prefer his evidence, and given evidence in the High Court.

BS EN ISO 17025 Proven Competence

Slip testing is an unregulated technical field where small mistakes can undermine results in Court.  Ben has tested for 3 different UKAS accredited labs (required to prove competence of their test operators), regularly takes part in comparative and proficiency testing schemes and is named as the trainer on more than 100 operator's certificates.
